INTRODUCTION
OmneBook (Formally, Fitnessity) is an all-in-one active experience marketplace that simplifies the booking of active experiences. It includes a business management software, a community for connecting & networking and an e-commerce to buy or rent things you need. Users can search, compare, rate, and book trainers to coaches, classes to therapists, adventures to tours, fun activities to events, buying or renting equipment and apparel all in one place.

PRIVACY MATTERS TO US
OmneBook, Inc. ("OmneBook,” “fit,” “our," or "us") has created this privacy policy in order to explain our privacy practices. OmneBook values your privacy. The following discloses our information-gathering and -dissemination practices for OmneBook. In this Privacy Policy ("Policy"), we describe the information we collect, how we use it, and when and with whom we share it. This Policy applies to all sites, mobile applications, and other online services (collectively, "Platform") made available by OmneBook. This Policy applies only to information collected on or through the Platform. It does not apply to information collected or obtained by or through any other means (including, without limitation, information collected offline, in person, over the telephone and/or by mail, or from third parties outside the Platform).
By using the platform, you do hereby warrant and represent that you have read, understand and agree to all terms and conditions stated herein, including our Terms of Use, available at http://www.fitnessity.net/terms, which is incorporated herein by reference, which govern the use of the platform and its services offered by OmneBook. You are giving OmneBook permission to use and store such information consistent with this privacy policy and our Terms of Service.
A customer of the Platform is hereinafter referred to as a "User," or collectively, the "Users." Providers offering any experiences including but not limited to, fun & engaging experiences, personal training, group fitness classes, fitness gyms, recreational faciilities, companies offering a adventure experience, fitness professionals, (fitness freelancers), fitness organizations, sports events, the fitnessity ecommerce store, jobs board, is hereinafter referred to as a "Service," or collectively, the "Services"

LINKS AND INFORMATION
The Platform may contain links to other websites or resources over which OmneBook does not have any control. Such links do not constitute an endorsement by OmneBook of those external websites. You acknowledge that OmneBook is providing these links to you only as a convenience, and further agree that OmneBook is not responsible for the content of such external websites or the protection and privacy of information you provide while visiting such external websites.
PERSONAL INFORMATION RECEIVED BY YOU
OmneBook collects personal information only if you voluntarily choose to share such information with OmneBook. You may browse the Site without disclosing any personal information. However, in order for you to take advantage of particular opportunities provided through the Platform, we may require that you furnish personal information.
When you register your account; when you sign up for newsletters, complete forms for optional programs, surveys, polls, contests, sweepstakes and promotions; When you make a purchase, when you submit a quote, when you hire a service, when you communicate with our service providers, when you interact with our blogs and forums. Also through communications transmitted through OmneBook either with us or with other users through the platform. Also through applications and your use of the OmneBook mobile application. You also may choose to send OmneBook personally identifying information in an email message containing information or inquiries about the Platform.
This list is illustrative, not exhaustive; the Privacy Policy applies to all use of the Platform.
The information you provide directly to us may concern you or others and may include, but is not limited to: (a) name; (b) zip code; (c) email address; (d) home or business telephone number; (e) home, business or mailing address; (f) demographic information (e.g., gender, age, political preference, education, race or ethnic origin, and other information relevant to user surveys and/or offers); (g) date of birth; (h) insurance information; (i) photographs; (j) information about your project, request or need; (k) video or audio files; and/or (l) in certain circumstances, payment and/or identity verification information. It may also include information specific to services you are requesting or offering through the Platform, such as a business name, service description, qualifications and credentials. You are not required to provide us with such information, but certain features of the Platform may not be accessible or available, absent the provision of the requested information.
Social Media Data Collection
We may collect information about you or others through OmneBook affiliates or through non-affiliated third parties. For example, you may be able to access the Platform through a social networking account, such as Facebook or Linked In. If you access the Platform through your social networking account, you may allow us to have access to certain information in your social networking profile. This may include your name, profile picture, gender, networks, user IDs, list of friends, location, date of birth, email address, photos, videos, people you follow and/or who follow you, and/or your posts or "likes."
Social networking sites, such as Facebook and Linked In, have their own policies for handling your information. For a description of how these sites may use and disclose your information including any information you make public, please consult the sites' privacy policies. We have no control over how any third-party site uses or discloses the personal information it collects about you.
We may also collect information about you or others through non-affiliated third parties. For example, to the extent permitted by law, we may, in our sole discretion, ask for and collect supplemental information from third parties, such as information about your credit from a credit bureau, or information to verify your identity or trustworthiness, or for other fraud or safety protection purposes. We may combine information that we collect from you through the Platform with information that we obtain from such third parties and information derived from any other products or services we provide.
ANNONYMOUS OR AGGREGATED DATA
OmneBook collects and stores certain data about the use of the Platform on an aggregate and/or anonymous basis. OmneBook does not link this information to anything personally identifiable to you.
COOKIES AND OTHER TECHNOLOGIES
Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your browser to enable our systems to recognize your browser and tell us how and when pages in our site are visited and by how many people. We and our third-party service providers may use cookies, clear GIFs, pixel tags, and other technologies that help us better understand user behavior, personalize preferences, perform research and analytics and improve the Platform. These technologies, for example, may allow us to tailor the Platform to your needs, save your password in password-protected areas, track the pages you visit, help us manage content, and compile statistics about Platform usage. We also use certain of these technologies to deliver advertisements through the Platform that may interest you. We or our third-party service providers may also use certain of these technologies in emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded. We may also use local shared objects (also known as "Flash cookies") to assist in delivering special content, such as video clips or animation. Flash cookies are stored on your device, but they are not managed through your web browser. Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We require that cookies be enabled for you to take advantage of the services we offer on OmneBook.
Ads appearing on OmneBook may be delivered to users by our advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by OmneBook and does not cover the use of cookies by any advertisers.
OMNEBOOK’S USE OF PERSONAL INFORMATION
Fitnessity uses Personal Information for the following general purposes:
- To provide our products and the Service.
- To enable you to use the services available through the Platform, including registering you for our services and verifying your identity and authority to use our services.
- For billing, identification and authentication, and fraud prevention.
- To analyze Platform usage and improve our products and the Services.
- To contact you and deliver administrative notices and communications relevant to your use of our products and services. To periodically send promotional emails regarding new products from OmneBook, special offers from OmneBook, or other information that may interest you
- To improve and maintain the Platform and for product development
- For customer support and to respond to your inquiries
- For internal market research, troubleshooting problems, and detecting and protecting against error, fraud or other criminal activity
- For distribution to third-party contractors that provide services to OmneBook and partners of OmneBook who are bound by privacy restrictions at least as restrictive as those set forth in this Policy
- For internal record-keeping purposes
- For other research and analytical purposes
- To resolve disputes, to protect ourselves and other users of the Platform, and to enforce any legal terms that govern your use of the Platform.
- To enforce our Terms of Service, and
- As otherwise set forth in the Policy.
Although we ensure that our third party agents (“Agents”) receiving your information are bound by privacy restrictions at least as restrictive as those set forth in this policy, OmneBook is not responsible for any issues that may arise regarding the Privacy Policies of any of its affiliates or advertiser. By using this website, you do hereby agree to hold OmneBook harmless from any claims and/or damages that may arise from the actions of any of its affiliates and/or advertisers.
Two things drive OmneBook decisions regarding the use of information collected from Users: 1) improving user experience by offering personalized services, content and advertising, and 2) market research.
Ads are a standard part of user experience on the Internet, and OmneBook believes that targeted advertising enhances this experience. OmneBook may use Cookies and other Technologies and Personal Information to place ads where they believe interested parties will see them.
In addition to banner ads, OmneBook may advertise products, companies and events that we think might interest you through the email address you provide.
OmneBook may analyze Personal Information and Web Navigational Data based on your interests and may use the analysis from this information in a way that doesn’t reveal a User’s personal information (“Market Research”) in order to:
- Market the Service
- Improve the likelihood of a sale to a group of Users
- Increase the likelihood that a group's experience with the Service is relevant to its interests as a whole
OmneBook uses data at the individual level to sell products and services to Users who express an interest in these products and services, through a poll for example, or to Users who can be presumed to have an interest based on results from our Market Research. OmneBook may use your email, cell phone number to call or text you in order to provide the Service. We use Financial Information solely as authorized by you in accordance with the Service.

CHILDREN'S PRIVACY
There are Services being offered for children and adults starting from age 2 and up. OmneBook requires everyone to be at least 13 years old before they can create an account (in some jurisdictions, this age limit may be higher). Parents or Legal Guardians are advised to be present and hands while their child creates an account on the Platform. Parents or Legal Guardians are recommended and advised in educating their child about the dangers of open communication on the Platform and creating boundaries and configuring the settings to keep their child safe and responsible. Creating an account with false info is a violation of our terms. This includes accounts registered on the behalf of someone under 13. If your underage child created an account on OmneBook, you can show them how to delete their account via settings. If you'd like to report an account belonging to someone under 13, please contact us at contact@omnebook.com. Note that we'll promptly delete the account of any child under the age of 13 that's reported to us. If we discover that an individual under 13 has provided us with personal information, we will close the account and delete such information. Please mark your inquiries "COPPA Information Request." Adults 18 and over are only permitted to communicate with a service provider or to book a Service on the OmneBook Platform. Children and Teens 17 and under are not permitted and are advised not to communicate, book a Service, or meet up with any Service Provider alone or without a parent or legal guardian present. Children are not permitted in traveling or being alone with any Service provider found on the OmneBook Platform even if a parent or legal guardian permits it. You acknowledge that OmneBook is not responsible for irresponsibility or abuse of Service of the Platform
SECURITY
We employ appropriate physical, procedural and technological security measures, which are reasonably designed to help protect your personal information from unauthorized access or disclosure. OmneBook may use encryption, passwords, and physical security measures to help protect your personal information against unauthorized access and disclosure. No security measures, however, are 100% fail safe. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that your personal information or private communications will not be collected, disclosed and/or used by others. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. OmneBook is not responsible for the unauthorized use of your information nor for any lost, stolen, compromised passwords, or for any activity on your account via unauthorized password activity.
UPDATING, DELETING, AND CORRECTING YOUR INFORMATION
You may review, correct and delete certain information about you by logging into the Platform and navigating to your settings page in "Your Dashboard." You must promptly update your Account information if it changes or is inaccurate. Upon your request, we will close your Account and remove your profile information from view as soon as reasonably possible. We may retain information from closed Accounts in order to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations of any user, enforce our Terms of Use, and/or for any other purposes otherwise permitted by law that we deem necessary in our sole discretion. You should understand, however, that once you transmit User Content through the Platform, you may not be able to change or remove it. Once we have deleted or removed your Account, you agree that Fitnessity will not be responsible to you for retaining information related to your Account.
YOUR CHOICES REGARDING EMAIL COMMUNICATIONS
We may send periodic promotional or informational emails to you. You may opt out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to 14 business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any services you have requested or received from us.
CHANGES TO THIS POLICY
THIS POLICY IS CURRENT AS OF THE EFFECTIVE DATE SET FORTH ABOVE. OMNEBOOK MAY, IN ITS SOLE AND ABSOLUTE DISCRETION, CHANGE THIS POLICY AT ANY TIME. OMNCEBOOK WILL POST ITS UPDATED POLICY ON THE PLATFORM OR SEND YOU AN EMAIL IN ADVANCE OF THE NEW EFFECTIVE DATE. OMNEBOOK ENCOURAGES YOU TO REVIEW THIS POLICY REGULARLY FOR ANY CHANGES. YOUR CONTINUED ACCESS TO OR USE OF THE PLATFORM WILL BE SUBJECT TO THE TERMS OF THE THEN-CURRENT POLICY.
CONSENT TO TRANSFER
Our computer systems are currently based in the United States, so your personal data will be processed by us in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. If you create an Account with the Platform as a visitor from outside the United States, by using the Platform, you agree to this Policy and you consent to the transfer of all such information to the United States, which may not offer an equivalent level of protection of that required in the European Union or certain other countries, and to the processing of that information as described in this Policy.
